Colo. brewery says river water tainted by wildfire

(AP) ? The maker of Fat Tire beer says it's using a reserve water supply because the water in northern Colorado's Poudre (POO'-der) River is tainted by a wildfire that destroyed hundreds of homes in June.

New Belgium Brewery objected when it was told it will soon have to go back to using water from the river. The company says if that happens, it would kill the flavor in the beer and make it undrinkable.

According to KUSA-TV (http://tinyurl.com/8s5g7oy ), the brewery is working with Fort Collins to continue using the water reserve.

The High Park Fire west of Fort Collins was one of the most destructive in Colorado history. It burned more than 250 homes, killed one person and scorched 136 square miles of mountain terrain.

Samsung reveals new Galaxy Note II

NEW YORK (AP) ? Fresh off a legal battle with Apple, Samsung is announcing a new version of the Galaxy Note, an offbeat, oversized smartphone that's become a surprise hit.

Samsung, the world's largest maker of phones, is revealing the Galaxy Note II at a trade show in Berlin. The 5.5-inch screen is narrower but longer than on the first version. The processor is faster, and the software has been further adapted for the included stylus ? the phone's signature feature.

While Apple has been releasing a new smartphone model each year, Samsung makes several to target different types of customers. That includes low-end phones for price-conscious customers. As a result, Samsung has been selling more smartphones than Apple this year.

The Note runs on Google's Android operating system but isn't among the phones that Apple is asking a judge to ban from the U.S., after a jury in California ruled last week that some of Samsung's Android phones violated Apple patents. The jury awarded Apple $1 billion in damages in a high-profile case that could force Samsung and other Android phone makers to rethink their designs.

The Note is designed to work well with a stylus for jotting notes and drawing on a screen, while styluses for other devices tend to be an afterthought. The Note's large screen also makes the phone more like a tablet and more suitable for playing games and consuming content. Samsung started selling a tablet version of the Note this month.

Samsung Electronics Co. says it has shipped 10 million first-generation Galaxy Note smartphone in one year.

Samsung says the new phone will go on sale in Europe and Asia in October. It did not say when it would launch with a U.S. carrier.

Sony's 84-inch 4K Bravia KD-84X9005 hits the IFA show floor, we go eyes-on

As ever, Sony's IFA press conference was a veritable storm of products, but CEO Kaz Hirai was clearly the most excited about the company's new 84-inch 4K TV, the Bravia KD-84X9005, and after beholding the thing for a bitt alongside a scrum of fellow tech journalists in the Sony booth at IFA, it's pretty clear why. The thing is beautiful -- and yeah, we can confirm, as Kaz suggested, that you really do want to stick out your hand and touch the picture when you're standing in front of it, particularly, when the video cycled through images of the ocean, with water droplets hitting the screen.

It 84 inches, this thing is a beast, with at least a dozen or so folks standing comfortable around it to catch a glimpse of the display. The Bravia is surprisingly thin for such a beast. There are speaker bars attached to either side of the display, with a control panel along the bottom. The stand consists of two metal bars holding up what's surely a weighty set. (AP) ? Will.i.am has premiered his new single ? from Mars.

The NASA rover Curiosity beamed to Earth his new song "Reach for the Stars" on Tuesday in the first music broadcast from another planet, to the delight of students who gathered at the Jet Propulsion Laboratory to listen.

The song had been uploaded to the rover, which landed near the equator of Mars, and played back ? a journey of some 700 million miles.

The musician, who promotes science and mathematics education, was among more than a dozen celebrities who were invited to JPL to watch Curiosity's landing earlier this month. Others included Wil Wheaton, Seth Green and Morgan Freeman.

In 2008, NASA beamed the Beatles' "Across the Universe" into the cosmos to commemorate the 40th anniversary of the song.

Commissioner defends police force in NYC gun fight

NEW YORK (AP) ? The police shooting near the Empire State Building last week is a testament to how quickly officers can fire off 16 rounds to take down an armed suspect.

But the nine wounded bystanders attest to another truth: Officers often miss.

Police Commissioner Raymond Kelly reiterated Monday that officials believe that two patrolmen followed proper police protocol once Jeffrey Johnson pulled a pistol on them moments after he ambushed a former co-worker ? an assessment supported by experts on police policy and training.

"When you're told that someone just killed someone around the corner, and five seconds later that person identified as the shooter points the gun at you ... it was the appropriate action to take," Kelly said at an unrelated press event in midtown Manhattan.

Dramatic security video of the Friday morning confrontation shows Johnson pointing the weapon at the officers, other pedestrians scattering and the two officers firing ? one from very close range, the other while retreating.

The police volley instantly killed Johnson, who never returned fire. Stray bullets, ricochets and fragments caused nonlife-threatening gunshot and graze wounds to nine civilians. Two remained hospitalized Monday in stable condition.

Kelly called it "unfortunate" that innocent people were hurt. But, he added, "Thank God, everybody is going to be all right."

Still, the bloodshed was another reminder of the public safety challenges that first emerged in the mid-1990s, when the police department abandoned bulky .38-caliber revolvers and armed officers with rapid-fire, 15-shot semiautomatics. At the time, the department claimed it needed the more modern weapons because criminals outgunned officers.

Experts said the number of bullets fired by the two officers wasn't surprising, nor was the fact that some of them missed their intended target.

"Those 16 rounds could have been fired in literally two seconds," said David Klinger, a University of Missouri criminology professor.

Eugene O'Donnell, a former New York City police officer who is now a lecturer at John Jay College of Criminal Justice, said: "I think people want to hear a magic number" of gunshots needed to take down a suspect.

"There is no magic number," he said.

Analysis shows NYPD officers "routinely, unfortunately, fire shots that miss," O'Donnell said. "It's uncommon for the cops to shoot, but when they do shoot, their hit rate is not very high."

According to the NYPD's annual firearms discharge report for 2010 ? the latest available ? officers fired their guns in 92 encounters ? the lowest number in the 40 years the department has tracked such data. But the same data showed the total number of bullets fired by police increased 24 percent, to 368 from 297.

NYPD officials say recruits are repeatedly cautioned to be aware of their surroundings and to try to take cover and assess a situation before opening fire. But once shooting starts, officers are trained to "shoot to stop" by firing at a target's "center mass," or torso.

"The rule as to how many shots should be fired is how many shots are necessary to terminate the threat," said Ed Mullins, president of the Sergeants Benevolent Association.

Throughout the semiautomatic era, the NYPD officer have been criticized for unleashing large fusillades. Most notable were the slayings of two unarmed men in vastly different settings: Amadou Diallo by 41 rounds while emerging from his Bronx home in 1999 and groom-to-be Sean Bell by 50 shots while sitting at the wheel of his car on a quiet Queens block in 2006.

In both of those cases, the officers who fired their guns were charged criminally but acquitted at nonjury trials.

The Johnson shooting also is under a routine review by a grand jury, but the experts predicted charges were unlikely.

The shooting appeared to be "a reasonable and acceptable use of force," said John Shane, a former Newark, N.J., police captain who also teaches at John Jay. "I have no doubt (the two officers) would not be indicted by a grand jury."

Added Shane: "It's actually a good thing that the video exists in the way that it does. ... This is the rare occasion where you get to see what happened before, during and after police fired."

Wounded bystanders have successfully sued police in the past.

William H. Cooper, who represented a bystander shot in the head by police during a gunfight with a robbery suspect on a Bronx street in 2000, said such cases typically boil down to officers trying to show that "the danger to the public was so excessive that they had every right to discharge their weapon" and plaintiffs arguing that deadly force "created such a danger to others that the risk didn't equal that decision."

In that case, city officials settled with the partially paralyzed man, Wilson Ramos, for $6 million.

In another civil case, the family of a woman taken hostage in 1993 by a bank robbery suspect and then killed by police exchanging fire with the gunman was awarded nearly $4 million. The appeals court found "police violated clearly established protocols and procedures," partly because police guidelines tell officers not to fire when shooting will unnecessarily endanger innocent people.

But in another case, the state's highest court threw out a negligence lawsuit from a woman who was hit by a police bullet during a 2005 shootout between officers and a suspect on a Harlem street. The Court of Appeals found the officers were justified in firing because they had a clear view of the suspect and hadn't seen the bystanders.

American Taliban seeks group prayer in Ind. prison

INDIANAPOLIS (AP) ? An American-born Taliban fighter imprisoned in Indiana will try to convince a federal judge that his religious freedom trumps security concerns in a closely watched trial that will examine how far prisons can go to ensure security in the age of terrorism.

John Walker Lindh was expected to testify Monday in Indianapolis during the first day of the trial over prayer policies in a tightly restricted prison unit where he and other high-risk inmates have severely limited contact with the outside world.

Lindh, 31, a Muslim convert who was charged with supporting terrorists after he was captured by U.S. troops in Afghanistan and later pleaded guilty to lesser charges, claims his religious rights are being violated because the federal prison in Terre Haute deprives him of daily group prayer.

Muslims are required to pray five times a day, and the Hanbali school to which Lindh belongs requires group prayer if it is possible. But inmates in the Communications Management Unit are allowed to pray together only once a week except during Ramadan. At other times, they must pray in their individual cells. Lindh says that doesn't meet the Quran's requirements and is inappropriate because he is forced to kneel in close proximity to his toilet.

The American Civil Liberties Union of Indiana, which is representing Lindh, contends the policy violates a federal law barring the government from restricting religious activities without showing a compelling need.

"This is an open unit where prisoners are basically out all day," said ACLU legal director Ken Falk, noting that inmates are allowed to play basketball and board games, watch television and converse as long as they speak English so the guards can understand.

"They can do basically any peaceful activity except praying," he said. "It makes no sense to say this is one activity we're going to prohibit in the name of security."

Joe Hogsett, the U.S. attorney for the Southern District of Indiana, said he believes decisions about prison regulations are best made by prison officials, "not by convicted terrorists and other dangerous criminals who reside there."

"Mr. Lindh is allowed to pray in his cell; he's allowed to pray wherever he happens to be as many times every day as his religion suggests to him that he should," Hogsett said. "Where the rules must draw the line is how often must prison officials allow prisoners to congregate together?"

Attorneys for the government maintain that Lindh's own behavior since he was placed in the unit in 2007 proves the risks of allowing group prayer.

The government says in court documents that Lindh delivered a "radical, all-Arabic sermon" to other Muslim prisoners in February that was in keeping with techniques in a manual seized from al-Qaida members that details how terrorists should conduct themselves when they are imprisoned.

Lindh's sermon proves "that religious activities led by Muslim inmates are being used as a vehicle for radicalization and violence in the CMU," the government claims.

Falk said Lindh's speech wasn't radical and was given during the weekly prayer that inmates are permitted. He said Lindh was not disciplined for the speech.

The self-contained unit in which Lindh resides has 43 inmates, 24 of whom are Muslim. Inmates are under open and covert audio and video surveillance, and except for talks with their attorney, all of their phone calls are monitored. Prisoners are not allowed to touch their family members when they come for their tightly limited visits. They must speak English at all times except when reciting ritual prayers in Arabic.

Without such tight security, the government claims, the prisoners would be able to conspire with outsiders to commit terrorist or criminal acts.

According to court documents, daily prayers were allowed from the time the unit opened in 2006 until May 2007, when Muslim inmates refused to stop in the middle of a prayer to return to their cells during a fire emergency.

The lawsuit was originally filed in 2009 by two Muslim inmates in the unit. Lindh joined the lawsuit in 2010, and the case has drawn far more attention since then. The other plaintiffs have dropped out as they were released from prison or transferred to other units.

Thomas Farr, a former diplomat who now teaches at Georgetown University and studies religion and terrorism, said common sense suggests that the prison's need for security would outweigh Lindh's religious rights.

Stanford University terrorism expert Martha Crenshaw said prison officials have legitimate security concerns but questioned how dangerous Lindh really was, noting that he was not a leader or an influential cleric. Even the government says Lindh is currently characterized as a minimum-security prisoner.

He had been charged with conspiring to kill Americans and support terrorists, but those charges were dropped in a plea agreement. He is serving a 20-year sentence for supplying services to the now-defunct Taliban government of Afghanistan and carrying explosives for them and is eligible for release in 2019.

"The fact that the charge of conspiring to kill Americans was dropped could be considered evidence that he was not a personally violent jihadist," Crenshaw said in an email.

"Certainly after 9/11 the pendulum has swung toward preventing terrorism at almost any cost," Crenshaw said. "I would like to think that it could be swinging back, but it swings slowly. Once established, routines are hard to change."

Mortar fire targeting Shiites kills 3 in Iraq

BAGHDAD (AP) ? A mortar attack targeting Shiite worshippers killed three people in eastern Baghdad on Friday, and authorities were investigating whether attackers set off explosions that sparked an early morning fire at a nightclub that left six dead.

Friday's violence was the first in Iraq after several days of calm during the three-day holiday earlier this week marking the end of the holy month of Ramadan. Before the Eid al-Fitr holiday, more than 200 people were killed in August violence across the country.

In the mortar attack, police said an explosive shell landed near a mosque shortly after the start of Friday prayers in the Shiite district of Sadr City. The sermon there was delivered by a backer of the Shiite firebrand cleric Muqtada al-Sadr. Eight people were wounded, including the preacher, Nassir al-Saadi.

Sunni insurgents frequently attack Shiites in an attempt to revive sectarian fighting and undermine the Shiite-dominated government.

In a separate incident, two police officers said attackers set off a bomb and then threw grenades from a speeding car at the Qasr al-Sharq, or "Palace of the East," hotel in Baghdad's downtown Karradah district early Friday. The hotel includes a hall that witnesses say is used as a nightclub.

Six people died and 12 were injured when a fire erupted inside the entryway of the hotel.

Other security officials, including Dhia al-Wakil, spokesman for the operations command in Baghdad, said authorities were still trying to determine if bombs set off the blaze.

"We do not want to speculate. We should wait for the results of the investigation," he said.

Hospital officials, who confirmed the casualties in both the mortar attack and the hotel incident, said victims in the hotel suffered injuries that included smoke inhalation as well as shrapnel wounds. The officials and most police officials spoke on condition of anonymity because they were not authorized to speak to journalists.

Nabil Sattar said he saw the fire at the hotel and rushed to help.

"We rescued some people who were suffering from suffocation, but others were forced to jump from the balconies in order to escape the smoke," he said.

One police officer investigating the fire, who declined to be named, blamed it on an intentional attack by Muslim extremists.

"They have radical ideas that reject alcohol, live music and dancing," he said.

Nightclubs are a form of entertainment considered taboo by conservative Muslims.

Iraqi officials had warned of large-scale attacks during the Islamic holiday, and security measures were tightened in all over the country, especially in the capital. Many public sector employees were given the whole week off, filling parks, restaurants and cafes late into the night.

Apple, Samsung Patent Case Will Test Jury

With so much technical and legal jargon to parse, I suspect most jurors will vote with their gut.

The jury on the Apple case has to digest a dizzying amount of technical and legal details. There are three different classes of patents being discussed: utility/technical, design, and trade dress?basically how a product looks. Jurors sat through more than 50 hours of testimony, including listening to 109 pages of jury instructions. The judge even mandated "stand up breaks" to keep the jury alert. Now, that jury just needs to decide, essentially, if Samsung will continue to sell phones and tablets in the United States.

With so much technical and legal jargon to parse, in the end, I suspect most jurors will vote with their gut. In their closing remarks, both sides made passionate, if over-simplified, arguments designed to appeal to the jurors' common sense. Indeed, evidence aside, the entire trial comes down to which of the following statements you are more likely to agree with:

Samsung's lawyer Charles Verhoeven contends, "Rather than compete in the marketplace, Apple is seeking to gain an edge in the courtroom. It's seeking to block its biggest and most serious competitor from even attending thegame."

Or:

Apple's attorney Harold McElhinny argues, "They sat with the iPhone and went feature by feature, copying it to the smallest detail. In those critical three months, Samsung was able to copy and incorporate the core part of Apple's four-year investment without taking any of the risks, because they were copying the world's most successful product."

After the trial, it will be interesting to see how much the evidence changed jurors' opinions and how much of their judgment was formed in advance. I'm not dismissing the American judicial process, but I follow technology for a living, and even I found the legal and technical details here arcane.

On its face, you might think the two giant tech firms could just split the difference, rather than risk a jury decision. After all, these guys are still business partners. Samsung makes 26 percent of all the components used in the iPhone. And yet, Apple is asking for at least $2.5 billion in damages.

A large number, to be sure, but so is the number of Samsung devices that Apple considers to be infringing on its patents. According to Apple, Samsung has sold 22.7 million infringing phones and tablets in the Unites States. Given the way the Galaxy Tab has fared, I think it is safe to say the vast majority of those were phones. The revenue from these sales is estimated to be $8.16 billion and Apple wants its cut.

By contrast, Samsung is countersuing for a measly $422 million, based largely on technical patents that it licenses widely to almost all cell phone manufacturers. In the course of the trial, these patents have served mostly to muck up the case. Valuing these technical patents is tricky, but it seems clear that Apple will have to pay something for them. For the most part, however, Samsung's patents are just here to balance out Apple claims. The real story is in Apple's broad design patents hold.

There is more at stake here for Samsung than for Apple, and money has very little to do with it. Apple doesn't need the money. It is sitting on the biggest pile of cash in corporate America and the world's biggest market cap to go with it. Apple wants to own the form factor. There is no question its iPhone revolutionized smartphone design and its iPad single-handedly created the consumer tablet market. Credit is undoubtedly due.

The questions now could test any patent or legal expert. What exactly does Apple own? Do consumers really confuse the Galaxy S II with the iPhone 4? And what will happen to the smartphone and tablet markets if Apple's claims are granted? Nine jurors in Silicon Valley are in the weeds trying to answer these questions right now.

And remember, the decision must be unanimous. Can we just skip this decision and move right to the appeal?

A retrospective on family and parents ? Big Bend Now

The father?s departing words to his grown children before he died were, ?take good care of your mother and don?t leave her alone.?? The days that followed before the final farewell were going to be very difficult times for the family.? When the oldest of the children arrived home, he shared his grief with his mother and his two brothers and sisters who had remained living in their hometown.

When the oldest brother embraced his mother providing comfort, she said, ?your father is not home; he left this morning and has not returned.?? The son knew that something was wrong; his mother?s mentality had been affected by his father?s death.? This added more to their grief as they remained silent with an understanding and hope that things would turn out well.

One would expect a mother with a devoted, faithful and loving relationship of close to sixty years with her companion would suffer complete breakdown upon losing him.? The mother?s frame of mind was that the head of the family had left for a short while and would eventually return.? Nevertheless, this did not bother her children; the oldest son thought, ?maybe this is a blessing, there is no extreme grief within his mother that will cause total, devastating heartbreak.?

And so, the days passed; the funeral and the father?s departure were a sad memory in his children?s mind and heart.? Their mother had to be cared for and the children knew that their father?s last request had to be fulfilled.? There was to be no question about that.? They were confronted with the task of providing all the care that their mother required.? She was not suffering from extreme illnesses or handicaps; it was to be companionship and ensuring proper attention and care.? That perpetual care was to be from waking up in the morning till the time of retiring at night every day of the week.

During the time that these devoted children took care of their mother, the need for more special care arose.? There were doctor?s appointments, medical treatments, medication, special diets and close monitoring.? The aging process was taking its toll.? The children still remained loving and committed to their mother as they had been from the beginning.

That entire episode and the end of that chapter reached its final point when their mother passed away.? Her children were overcome with sadness for losing their one and only.? However, there was brightness in that departure.? It was the fulfillment and the obedience of honoring their father?s last wish.? It should be understandable that this was not the only reason for such care; there is that endless love in

the heart that comes with the upbringing within a home and family where love, harmony and unity reign and is the dominant factor.? Hopefully, it will carry on with the remaining children from that special family.? For you see: their mother?s words were heard repeatedly;? and they still echo; ?see yourselves as brothers and sisters; help one another and don?t fight.?? Maybe those children will abide by one important from the list of Divine commandments.? Also, it has been one of their mother?s long lasting desires.

The above mentioned categories are generic; and the number and types of categories vary from person to person. One thing you need to remember is to track even a small expense ? it may affect your savings.

Step 3: Prioritize your spending
After tracking all your expenses, prioritize them as necessary and discretionary expenses.

? Necessary expenses: These expenses are made based on your basic needs and requirements and hence, these are also called living expenses. For example, money you spend on groceries, utilities, insurance, medicines, transportation, debt payments, etc.

? Discretionary expenses: If you have made any expense based on your 'wants' rather than 'needs', then such an expense is called discretionary expense. These expenses are not necessary for your survival. For example, money you spend on vacations, eating out, cosmetics, birthday gifts, luxury clothing, etc. These expenses are completely for entertainment and recreational purposes.

This step is very crucial because it lets you know your spending behaviour ? whether you have made necessary expenses or unnecessary expenses. Reduce unnecessary expenses to save some money for emergency needs.

Step 4: Calculate surplus or deficit
Now, you need to add up all the expenses that come under living expense category and all expenses that come under discretionary expense category. Subtract these two types of expenses from your income.

If the amount is a negative value, then you are in deficit. If the amount is a positive value, then you have generated some surplus, which can be used for savings.

Creating your own budget plan according to your needs is better than downloading budgeting software. You can use spread-sheet to create one. Living without a budget is like driving a car towards unknown destination. A clear budget will help you attain financial stability. So, create a good budget and stick to it.
